71 out of 87 witness statement, Supreme Court forced to acquit the accused

The Supreme Court on Friday acquitted six accused in a murder case. Most of the witnesses in the case turned back. These include the son of the deceased. This is why the court was forced to acquit the killers. There were a total of 87 witnesses in this “unresolved crime”, out of which 71 were retracted by their statements. A bench of Justice Sudhanshu Dhulia and Justice K. Vinod Chandran rejected the Karnataka High Court’s order of 27 September 2023, in which six accused were convicted by canceling the lower court’s decision.

Justice Chandran said in a 49 -page judgment written by the bench that the accused are acquitted with a heavy heart in the context of lack of evidence related to this unresolved crime. The bench said, “Reversing the High Court verdict and restoration of the lower court’s verdict.” The bench expressed grief over the witnesses to retract the court and “very enthusiastic” investigation, saying that the investigation “was completely ignored of the basic principles of criminal law”, in such circumstances, the prosecution becomes a joking “in such circumstances”.

Court said- this bizarre case

The bench said, “Witnesses refuse their earlier statements, refuse to identify seizures, express ignorance of the serious conditions mentioned during the investigation and the witnesses become blind.” This is a bizarre case in which 71 out of a total of 87 witnesses were retracted, causing the prosecution to depend on the testimony of the police and the official witnesses. “The court further said,” Even an important eyewitness in the case failed to identify his father’s killers. ”

Order to release the accused

The apex court said that the High Court trusted the testimony of police and official witnesses to convict the accused. After analyzing the testimony of the evidence and witnesses, the “only approach” of the court was that the prosecution failed to prove the allegations against the accused. The court said that if the accused is in custody and is not required in any other case, it should be released.

What is the matter?

On 28 April 2011, a person named Ramakrishna was murdered in Karnataka due to a dispute between two brothers. At the time of the murder, he was to go for a walk with his son. Ramakrishna first worked for a brother, but later he started working for another brother. After this, his six old colleagues conspired to kill Ramakrishna, but all were biring in the absence of evidence and witnesses. (Input- PTI language)
