The Allahabad High Court overturned the conviction in the 2022 inflammatory speech case of Mau MLA Abbas Ansari, son of gangster -turned -politician Mukhtar Ansari and restored his assembly membership.
Suheldev Bharatiya Samaj Party MLA Abbas Ansari received a big relief on Wednesday when the Allahabad High Court overturned the order of his conviction of the MP/MLA court. He was disqualified from the Uttar Pradesh Legislative Assembly after being convicted in the inflammatory speech case.
Talking to ANI, his lawyer Upendra Upadhyay said, “Abbas Ansari’s membership of the UP Assembly was canceled, and he was sentenced to two years by the CJM court. In response, he filed an appeal in the session court, who gave him bail, but did not stop the punishment, which could not restore his membership. After this, he went to the High Court. Went.”
Reacting to the order of the High Court, Mukhtar Ansari’s elder brother Sibgatullah Ansari called it “victory for justice and fairness”.
He said, “This is a victory of justice and fairness. We all believed that we are innocent and we will get justice, and the punishment given to Abbas Ansari has been canceled.” In today’s time, speaking in court matters is also a crime … It is only a crime that we have got justice, this is the victory of justice … This is the victory of justice … even today the judiciary is alive in the judiciary. On July 17, a petition was filed in the High Court to stop the two -year sentence given by MP/MLA Special Court Mau.
On May 31, the Chief Judicial Magistrate (MP-MLA) court in Mau district had imprisoned Abbas Ansari, a two-year imprisonment and a fine of Rs 3000 in a 2022 inflammatory speech case to the Chief Judicial Magistrate (MP-MLA) court of Suheldev Bharatiya Samaj Party and son of deceased mafia don Mukhtar Ansari. On this basis, he had to lose his MLA post on 1 June 2025.
Mansoor Ansari, a close associate of Abbas Ansari, was also sentenced to six months imprisonment. A case was registered against Mau district administration for making inflammatory speeches during the implementation of Adarsh Code of Conduct on Ansari. Earlier, Allahabad High Court refused to give them advance bail in the same case. He approached the apex court against the High Court’s December 2023 order.
On 19 December 2023, the High Court dismissed Ansari’s anticipatory bail plea and said that a crime is formed in view of the facts and circumstances of the case.
In March 2022, an FIR was lodged against Abbas Ansari, Omar Ansari and others at the Kotwali police station in Mau district. It was alleged in the FIR that on March 3, 2022, Abbas Ansari, Omar Ansari and organizer Mansoor Ahmad Ansari had called for equal account with the Mau administration in a public meeting.
Abbas Ansari contested the 2022 state assembly elections on the Sadar seat of Mau on the ticket of the Samajwadi Party’s then coalition partner Suheldev Bharatiya Samaj Party (SBSP) and won. According to the Public Representation Act, there may be disgrace by holding public positions until the appeal is pending due to the punishment of two years or more.
