The Supreme Court on Thursday said that the first and important issue in cases related to Rohingya is to decide whether they are refugees or illegal infiltrators. Justice Suryakant, Dipankar Dutta and N. The bench of Koteshwar Singh said that once this situation becomes clear, it will be easy to resolve all further issues. The court made this comment during the hearing of a case related to Rohingya.
The bench said, “First it should be decided whether Rohingya is a refugee? If yes, what will they get protection, privileges or rights?”
The court also said that the second big question is that if Rohingya is not a refugee and has illegally entered India, is the action of deporting them by the central and state governments is appropriate?
The court also asked, “If Rohingya is considered an illegal intruder, can they be detained indefinitely? Or are they entitled to be released on bail under the conditions considered suitable by the court?”
Along with this, the bench also raised the question that those Rohingya who are not in custody and are living in refugee camps are providing basic facilities like drinking water, sanitation and education to them?
