The Karnataka High Court on Tuesday refused to give any interim relief to Nikhil Sosle, a marketing head of Royal Challengers Bangalore (RCB), in connection with a stampede outside the stadium here on June 4 and the death of 11 people in it.
The court reserved its order on Sosh’s petition till 11 June. Sosle was arrested by the Central Crime Branch (CCB) on June 6 from the Kepegowda International Airport in Bengaluru when he was going to Dubai.
In his petition, Sose had questioned the validity of arresting him in the early hours of June 6 and alleged that the police action was affected by political instructions.

On behalf of Sosh, Senior Advocate S. Chauta argued that the arrest was made in violation of the process, especially when the investigation had already been handed over to the Crime Investigation Department (CID).
Chauta argued, referring to Section 55 of the Indian Civil Protection Code (BNSS), “He is saying that he (CCB), being a senior officer, can arrest him.” Even if this right is gained, it should have been told in writing at the time of arrest.
Referring to a decision of the Supreme Court, he said, “Finally the question is of freedom. Even though there is a provision of punishment for more than seven years in crime, but unless you have authentic reasons to believe, you cannot deprive a person from freedom.
The court also sought clarity on the notification to transfer the case to the CID and asked why the CCB suddenly intervened to the investigation.
The judge said, “The problem is that CCB suddenly came.” All the public knows that the investigation was handed over to the CID. After that the CCB arrests the morning. What happened in the meantime? ”
Chauta questioned on the basis of arrest.
He asked, “The first arrest of a freelancer named Shamant was made by Ashok Nagar Police at three o’clock in the morning. Sosh was arrested by CCB at 3:30 in the morning. ”
He also argued that there is no clear mention of the role of Sosa and others arrested in the FIR.
