Mumbai The Bombay High Court has dismissed a petition for cancellation of the FIR filed against him, not giving relief to a teacher named Farah Diba. Bombay High Court Justice Ajay Gadkari and Justice Rajesh Patil said that the woman made fun of Operation Sindoor in the Society’s WhatsApp status. Apart from this, Farah Diba showed India’s tricolor burning on her WhatsApp status and in another status, PM Narendra Modi was shown sitting on a rocket. The Bombay High Court wrote in its 10 -page order that what the woman did is going to invite Sections 152, 196, 197, 352 and 353 of BNS.
The Bombay High Court in its order also mentioned that accused Farah Diba had told the complainant that his father and mother’s family live in Pakistan. For this reason, he also called India a Makkar. The High Court bench said that this shows what caused the accused to commit the crime. The bench said that even if the accused apologized to the complainant, he has suffered a lot due to his action. The Bombay High Court said that photos have been given before the court with the petition. Which shows that all the people came to the police stations against the accused Farah Diba.
The Bombay High Court bench has also said in the order that the accused has been educated. He should have thought about what benefits and disadvantages could be from expressing thoughts in this way. The court said that the police should now investigate whether the accused woman’s father and mother’s families belong to Pakistan or not. The bench also pointed out the decision of the Allahabad High Court in its order, stating that freedom of expression does not mean that people sitting in high positions should be insulted or extending disharmony among citizens. After this decision of the Bombay High Court, Farah Diba’s difficulty is expected to increase.
