Kerala High Court gave an important decision regarding black film.

Recently, Kerala High Court has given an important order regarding applying black film on car mirrors. Many times you must have seen the police removing black film from the glass of cars or issuing challans. In this regard, two petitions were filed in the Kerala High Court. While hearing both the petitions, Kerala High Court has given an important decision. In fact, the Kerala High Court has termed it wrong to stop applying plastic film or cooling film on car mirrors. What did the Kerala High Court say?

Let us inform that on September 12, 2024, both the petitions filed in the Kerala High Court were heard. The court said in its decision after the hearing that it is not right to stop applying plastic film or cooling film on the windows of vehicles as per the rules. If the police is issuing challan if there is cooling film or plastic on the window glass, then it is wrong. The court said that if there is a film on the glass of the car under the rules of the Central Motor Vehicle Act, 1989, then issuing the challan would be wrong. Car drivers can get plastic films installed on windows as per their need. However, completely black glass or film with zero transparency will still be fined. This decision of Kerala High Court will provide great relief to car drivers.

What are the rules?

In fact, in the year 2012, the Supreme Court had completely banned black films. The court had said that having black film on vehicles poses a threat to public safety. However, as per the amendment to Section 100 of the Central Motor Vehicles Rules, effective from April 1, 2021, the use of ‘safety glazing’ instead of safety glass on the front, rear and sides of motor vehicles has been permitted. According to the revised rules, 70 percent transparency is required on the front and rear glass and 50 percent transparency on the sides. Referring to this amendment, the court made it clear that the use of such films is legal. However, if tinted glasses with zero visibility are installed in the car, a fine of Rs 500 can be imposed. If the driver repeatedly breaks the rules, his license can be suspended and the vehicle can be confiscated.
