An important comment from the Madhya Pradesh High Court has come to light regarding the wife being forced to leave her job. The High Court, while accepting the petition of a 33-year-old woman for divorce, has said that forcing the wife to leave her job and live as per her wishes and ways by the husband comes under the category of cruelty. The woman, posted in Indore as a manager in a central government undertaking, had filed a divorce application against her husband in the family court alleging that he was mentally harassing her to leave her job and live with him in Bhopal. The family court had rejected this application of the woman. After which the woman challenged this order of the Family Court in the High Court.
What else did the High Court say?
The bench of High Court Chief Justice Suresh Kumar Kait and Justice Sushruta Arvind Dharmadhikari, considering the legal aspects, overturned the decision of the lower court and accepted the divorce petition of the woman. In the judgment delivered on November 13, the bench said, “Whether the husband or wife wants to live together or not is their choice. Neither of the spouses can force the other party not to do a job or to do a job as per the choice of the spouse.” The High Court said that in the present case the husband pressurized the wife to leave her government job. Leave it. The court said that forcing the wife to leave her job and live according to the wishes and ways of her husband comes in the category of cruelty.

The woman’s lawyer Raghavendra Singh Raghuvanshi said, “After marriage in 2014, my client (client) and her husband were preparing for government recruitment examinations by staying in Bhopal. In 2017, my party got a job in a government undertaking, but her husband’s ego started getting hurt due to him not getting any employment.” He said that his party’s husband was allegedly harassing his wife, posted as a manager in Indore. But he started harassing her and putting pressure on her to leave her government job and live with him in Bhopal.
According to Raghuvanshi, the woman’s husband told her that whenever she did not get any employment, she too should not do any job. He said, “Due to the wife not being ready for this statement of her husband, differences started increasing in the couple. Troubled by her husband’s mental torture, the woman finally decided to divorce.” (With language inputs)
