At the honor ceremony held on Wednesday at his hometown Amravati in Maharashtra, Chief Justice Gavai said that the constitution is the highest in India. Addressing the honor ceremony for themselves on behalf of the Bar Association, CJI BR Gavai said that there is always a discussion on who is the highest in the three parts of democracy, legislature, judiciary and executive? He said that many people say that Parliament is supreme, but according to me the Constitution of India is at the top.

CJI Gawai said that all three organs of democracy work according to the constitution. He said that Parliament has the right to change the Constitution, but it cannot change the original structure of the Constitution. CJI BR Gawai said that he always stood with fundamental rights and constitution. He also gave an example of the decision given in the bulldozer case. The CJI also said that no judge becomes independent by giving a verdict against the government. He said that we have not only power but also responsibility. BR Gawai said that every judge should remember that we are the patron of civil rights, constitutional values ​​and principles. No judge should wonder what people will say. The CJI said that this cannot be a part of the decision making process.

Please tell that in April this year, Vice President and Rajya Sabha Chairman Jagdeep Dhankhar described Parliament as supreme. In the Delhi University program, the Vice President said that there is no authority above Parliament. The reason for this was that he had told that the MPs who came are representatives of the people. Dhankhar had said about criticism of his opinion about the Supreme Court that every word spoken by a constitutional officer is directed by the supreme national interest. He had said that the MPs have the right to decide what the constitution would be and what amendments will be taken. He had said that there is no one above MPs.
