It took 66 years to settle a land dispute in the national capital Delhi. The original parties have died long ago and now a local court has said that the matter is not worth considering in its present form.
Civil Judge Kapil Gupta was hearing a 1959 case, in which the plaintiff Mohan Lal had requested the court to issue compulsory prohibition against the builder, as they are constructing the colony by encroaching on their land without their consent. .
The court said that the case is eligible to be dismissed, as the plaintiff was not occupied by the land located in Basai Darapur area of Delhi and was only seeking relief by issuing a formal order.
Advocate Amit Kumar, who is representing the defendant, said that the colony has already been constructed, due to which the petition to stop the developers has become meaningless.
The court said in its order of February 3, “It has been reported that the defendants are doing business of selling plots and described themselves as the owner of a colony called Mansarovar Garden on Najafgarh Road.”
The court said that the petition claimed that the small red and other defendants had presented a layout scheme before the Delhi Development Authority (DDA) for the approval of Mansarovar Garden Colony under the Urban Planning Scheme and “from Mohan Lal The disputed land concerned was included in it without their consent. “
The court said that the case is “not to consider in the current form” because it has not been demanded to get possession, and only a demand has been sought. “
The court dismissed the case, saying that the plaintiff failed to prove his claims and allegations.
