The Delhi High Court on Friday refused to pass instructions by taking self -cognizance on the claim of a person, stating that his complaint sent to the Chairman of the Central Board of Direct Taxes for investigation against a judge has not been considered. Without naming the judge, the plaintiff said, “I don’t want one person to tarnish the image of hundreds of judges.”
On this, Chief Justice D.K. A bench headed by Upadhyay said, “Nobody wants this.” This mention was made before the bench of Chief Justice Upadhyay and Justice Tushar Rao Gedela in the backdrop of the controversy continuing to receive a cash sack from Justice Yashwant Verma’s official residence.
The person said that he was distressed by not considering his complaint given to the Chairman of CBDT to order an inquiry against the judge concerned. When the bench asked him what he wanted here and whether he has filed a petition in the High Court, the person said, “Can you please pass instructions by taking automatic cognizance on it.”
The bench clarified that he should not give this suggestion, and “is for the automatic cognizance court, not for you”. Then the person said, “Then I will file a PIL with the Central Vigilance Commission (CVC) complaint and police complaint.” To this, the bench said, “We are not sitting here to advise you whatever you want.”
