The Delhi High Court on Wednesday summoned the police on the bail plea of former Aam Aadmi Party (AAP) MLA Naresh Balyan, arrested in the MCOCA case.
Justice Manoj Jain issued a notice to Delhi Police on Balyan’s bail plea and fixed the next date of hearing July 3.
The High Court also asked the Jail Superintendent to send a report on the prisoner list of Balyan and his medical condition, as the accused has also sought interim bail on health basis.
This directed the National Capital Region Government to file an update commodity status report in the case.
Senior advocate Sunil Dalal, who was representing Balyan, said that his client was arrested on December 4, 2024 in the MCOCA case, on the day a lower court granted him bail in a case of recovery of alleged extortion, and he has been in custody since then.
After filing the charge sheet in the police case, Balyan withdrew a bail plea from the High Court. He filed a petition in the lower court for bail, but his bail plea was rejected on 27 May.
Balyan’s lawyer had earlier argued that “there is no evidence” against him and the case is “completely fruitless”, while claimed that Balyan’s name is not even in the FIR.
The special lawyer of the police claimed that there are Aadhaar to implement MCOCA against Balyan and they cannot be given any relief.
Balyan was accused of being “collaborative” in an organized crime syndicate.
