The Central Bureau of Investigation (CBI) will seek death penalty for Sanjay Roy in the High Court in the RG Kar rape and murder case. Sanjay Roy was sentenced to life imprisonment in this case by a subordinate court in Sealdah. Officials gave this information on Wednesday.
He said that the CBI has received legal advice that this case can be kept in the ‘rarest of the rare’ category and only death penalty is appropriate for the accused.
The CBI is likely to file an appeal against the Sealdah court order by Friday with detailed arguments in favor of death penalty, officials said.
The CBI’s request for death penalty for Roy was rejected by the subordinate court. Sealdah Additional District and Sessions Judge Anirban Das had said in his judgment that this crime does not fall in the ‘rarest of the rare’ category.
While sentencing Roy on Monday, Judge Das had said, “CBI requested for death penalty.” The defense counsel prayed that a prison sentence be imposed instead of the death penalty. This crime does not fall in the ‘rarest of the rare’ category.
Judge Das had told Roy, “For the injuries you caused to the victim during the act of rape, which resulted in her death, I am sentencing you to remain behind bars till the last day of your life.” ‘
