Hearing in Supreme Court on Monday
The Supreme Court will hear the petitions challenging the constitutional validity of the Waqf (Amendment) Act on Monday. A few weeks ago, the government banned the implementation of two main points of this controversial law in view of the Supreme Court questions.
May 5 was fixed for hearing date
The Center had informed the court on 17 April that it would not indulge in non-defense of other Waqf properties including ‘Waqf by user’ by May 5, the next date of hearing of the case, nor would they make any appointments in the Central Waqf Council and the Board.
The Center made this appeal to the court
On behalf of the Center, Solicitor General Tushar Mehta had told the bench of Chief Justice Sanjeev Khanna, Justice Sanjay Kumar and Justice KV Vishwanathan that the law passed after proper deliberations by Parliament should not be banned without hearing the government.
The court gave this answer
During the hearing, the Supreme Court said that the Waqf properties already registered or declared through notification, including the ‘Waqf by user’, will neither be teased nor notified until the next hearing date.
Three judges will hear bench
The bench then gave the Center a week to file a preliminary reply on petitions challenging the validity of the law and set the next hearing of the case for May 5. A bench of three judges of the Supreme Court will hear five petitions on Monday.
Owaisi has also filed a petition
The group of petitions also includes a petition filed by AIMIM chief and Hyderabad MP Asaduddin Owaisi. After the approval of President Draupadi Murmu on April 5, the Center notified the Waqf (Amendment) Act, 2025 last month.
Bill passed from Lok Sabha and Rajya Sabha
The Waqf (Amendment) Bill was passed by the Lok Sabha with the support of 288 members, while 232 MPs were against it. In the Rajya Sabha, 128 members voted in its favor and 95 members against it. Many political parties, Muslim organizations and NGOs have moved the apex court challenging the validity of the Act. (With language input)
