What is bail?
Let us tell you that the candidate has to deposit a fixed amount with the Election Commission to contest the election. This amount is called ‘bail amount’ or security deposit. It has been arranged in Election Conduct Rules, 1961 (The Conduct of Election Rules, 1961). In the assembly elections, the general class candidate has to deposit Rs 10,000 and SC-ST candidate has to deposit Rs 5 thousand.
Why is the bail confiscated?
If the candidate does not get 1/6 of total votes in the election, ie 16.66% votes, then this amount is confiscated. The commission seizes the bail amount deposited by that candidate with the Election Commission. The same process is termed as forfeed to bail in elections. If the candidate gets the fixed vote (more than 16.66% vote), then this bail amount is returned to him. Apart from this, if a candidate withdraws his nomination or his enrollment is canceled for some reason, then the bail amount is also refunded in this situation.
So now you must have come to know that the candidate’s bail is confiscated by the Election Commission but the reason behind this is the reason. It is a type of fine, which decides that candidates should take their candidature seriously and do not play in the electoral process.
How much is the loss?
For the Lok Sabha elections, the general category candidates have to deposit a bail amount of Rs 25,000 while the SC-ST candidate has to pay Rs 12500 thousand. In the assembly elections, the general class candidate has to deposit Rs 10,000 as a bail amount and the candidate of SC-ST category has to deposit an amount of Rs 5000.
