In one such case, the Jammu and Kashmir High Court has made strict remarks. The Jammu and Kashmir High Court has ordered the demolition of the illegal construction of a hotel in Srinagar, saying that continuous illegal construction in the city is a matter of concern. The bench of Justice Sanjeev Kumar and Justice Sanjay Parihar also said that the time has come to take action against the officers who approved illegal construction.
The Jammu and Kashmir High Court said that the rules of building a building by changing the policy should be seen again. The court said that there is a need to impose strict penalty against those officers who are involved in approving illegal buildings. The bench of the Jammu and Kashmir High Court said that the setback rules were not followed in the hotel constructed in Srinagar. The court said that under the building plan, the built up area of each hotel of the hotel should have been 9159 square fit, but 19900 square fit built up area was created. The counsel for the hotel owners had requested the court to impose a fine instead of demolishing the construction, but it was not considered.
The lawyer of the hotel owners had argued that a lot of money has been spent in building the hotel. On this, the court said that those who do not obey the law cannot be treated with equal. The court said that those who violate the law cannot be shown mercy. In this case, the court found that three separate construction approval was taken in the name of building hostels and guest houses, but all three were mixed and made a hotel. Whereas, there are very difficult conditions to build a hotel. The court said in a sharp comment that without the connivance of the officers of the Srinagar Development Authority, the rules could not be such a major violation. The court asked the Jammu and Kashmir government to take strict action against these officers.
