New Delhi. Allahabad High Court Judge Justice Yashwant Verma case was heard in the Supreme Court today and the court reserved its verdict. In front of the bench of Justice Dipankar Dutta and Justice AG Christ, Justice Verma’s lawyer Kapil Sibal argued that it is unconstitutional to recommend impeachment by the Chief Justice of the Supreme Court. He said that there is no provision that impeachment against the High Court or Supreme Court judge should be recommended on the basis of the report of the internal inquiry committee.
Not only this, Sibal also questioned the decision to constitute an inquiry committee against Justice Yashwant Verma by former Chief Justice of Supreme Court Sanjeev Khanna. The Supreme Court bench got angry at this argument of Kapil Sibal and he said, Chief Justice is not a post office. The Supreme Court bench said that the system of internal inquiry committee was implemented in the year 1999. Action is ensured only on the basis of his report. The Chief Justice has responsibility for the country, if he feels that there is something wrong then he can make the President and the Prime Minister aware of it.
Earlier, the Supreme Court told Justice Yashwant Verma, you should have come to us first against the report of the Internal Investigation Committee. Kapil Sibal told the Supreme Court that Justice Yashwant Verma did not contact first as the tape had been released and his reputation had already faded. Let us tell you that Justice Yashwant Verma was found guilty by a three -judge committee in the case of recovery of burnt cash from the house. Justice Verma has applied in the Supreme Court demanding the dismissal of the report of the inquiry committee. Based on this report, the then CJI had recommended the government to bring impeachment motion against Justice Verma.
