The Congress government of Karnataka has given 4 percent reservation to Muslims in government contracts, but if we talk about constitutional provisions, then this decision of the Congress government of Karnataka in the court seems difficult to stand. The reason for this is that the Constitution has refused to give reservation on religious grounds. Reservation is currently given in jobs and educational institutions in the country. There is no provision for religious minorities in these reservation. At the same time, the case of abolition of Muslim reservation in Karnataka is also pending in the Supreme Court. The BJP government of Karnataka abolished Muslim reservation.
Talking about the Constitution, it has a provision to give reservation to SC, ST and OBC. Apart from this, the Modi government has made a provision of 10 percent reservation for economically weaker sections. All these reservations are for educational institutions and government jobs. There is a provision of reservation in Articles 15 and 16 of the Constitution, but it has not written to give reservation on religious grounds anywhere. In such a situation, the 4 percent reservation given by the Karnataka government to the Muslim community in government contracts does not appear according to the constitution. For this reason, if someone challenges the decision of the Congress government of Karnataka in the court, then it can also be canceled.
When there was a BJP government in Karnataka, it had abolished 4 per cent reservation in educational institutions and jobs on behalf of the previous Congress government. When people turned to the Supreme Court against the BJP government, the Karnataka government said in the court that the reservation given to the Muslim community is against the constitution. At the same time, the Muslim community says that the Karnataka government did not collect any information on ending the reservation. The Supreme Court has already banned reservation on religious grounds. In such a situation, the Congress government of Karnataka is expected to hang a sword on the latest decision on reservation in contracts.
