The Supreme Court on Thursday made an important comment, saying that the strict provisions of the laws made for the welfare of women are not intended to punish, threaten, or extort money from their husbands. A bench of Justice BV Nagarathna and Justice Pankaj Mithal made this statement while they were hearing a case related to the separation of a couple. The bench clarified that Hindu marriage is a sacred practice and is meant to strengthen the foundation of the family and not a commercial arrangement.
“Strict provisions for safety and well-being”
The Court said that the apex court has made strong observations several times regarding the application of various sections of the Indian Penal Code, especially in cases related to matrimonial disputes. These include crimes like rape, criminal intimidation and cruelty. The Court also said that women need to understand that these strict provisions of the law are for their safety and well-being. These should never be used as a means to punish husbands, intimidate them, dominate them, or extort money from them.”
“Some women misuse these serious allegations”
The comments were made in a case in which a husband was ordered to pay permanent alimony of Rs 12 crore to his wife as full and final settlement of all her claims. The bench said that the relationship had completely broken down and hence ordered the dissolution of the marriage. However, the Court expressed concern over cases where the wife and her family used criminal complaints to make demands on her husband and his family, taking recourse to the seriousness of the crimes. The Court said that some women misuse these serious allegations, which is not the purpose of these provisions.
The Supreme Court also said that the police often act hastily in such cases and arrest the husband and his relatives, including elderly parents and grandparents, without any solid basis. The bench said that the subordinate courts also refrain from granting bail to the accused due to the seriousness of the crime in the FIR. (language input)
