New Delhi. Muslim organizations and leaders have filed petitions in the Supreme Court against the Waqf Amendment Act. Amidst all this, Parul Kheda, a resident of Gautam Buddha Nagar of UP, Noida, has also moved the Supreme Court. Parul Kheda has challenged the Waqf Amendment Act and described it as discriminatory towards Hindus and non -Muslims. The petitioner has appealed to the Supreme Court to protect the property of Hindus and other non -Muslims with the notice, notification and order of the Waqf Board. That is, the court should order that under the Waqf Act, any notice, rules, order or notification will not apply to the property of Hindus and non -Muslims.

In the petition filed in the Supreme Court, several sections of the Waqf Act have been described against the Constitution. The petitioner has said that the Waqf Act 1995 is against the principle of secularism and equality. The special rights given to Waqf boards about properties violate the equality, religious freedom given in the Constitution. Parul Kheda has said in his petition that Hindus and non -Muslims have no ways to prevent their religious property from incorporating them as Waqf. In this, provision has not been made in the Waqf Act 1995 to give the affected a chance to hear and include his property in the Waqf.

Apart from this, the petition states that there is no provision to issue public notice in the Waqf Act. The Waqf Board has the right to remove encroachment from its property. Whereas, those who have other religious properties do not have this right. The petition also states that the Waqf Tribunal cannot be able to settle the dispute. Civil property disputes are settled well in the court. Also, it has been said in the petition that in Section 8 of the Waqf Act 1995, the expenditure on issuing the assets and notification is incurred from the government treasury. Which is a violation of Article 27 of the Constitution. All the petitions related to the Waqf Act will hear a 3 -judge bench headed by Chief Justice Sanjeev Khanna in the Supreme Court on 16 April.
