New Delhi. The Supreme Court has canceled the rape case against the retired army officer. The Supreme Court said that the woman who complained had similarly filed a rape case on 8 people earlier, but she did not participate in the police investigation. Also, despite sending the notice, he was not produced in the Supreme Court. Justice Sudhanshu Dhulia and Justice K. A bench of the Supreme Court with Vinod Chandran said that in view of the situation in the rape case filed against retired army officer Captain Rakesh Walia, the court is of the opinion that the matter is to misuse the law.
Earlier, Captain Rakesh Walia had moved the Delhi High Court to cancel the rape case filed against himself. Retired Army Officer appealed to the Supreme Court for not getting relief from there. The bench of the Supreme Court also commented on the Delhi High Court. The Supreme Court bench said that the Delhi High Court should have canceled the case filed against the retired captain under Section 482 of CRPC which is now Section 528 of BNS. The woman who accused the retired captain of rape is 39 years old. He has 2 daughters. The woman said that she stays away from her husband for 3 years.
In the complaint to the police, the woman alleged that she used to do freelance modeling earlier, but left the job in search of a job. The woman had alleged that she came in contact with retired Captain Rakesh Walia through Facebook. The woman claimed that Captain Walia assured her to get a job and called her to meet for modeling. According to the woman, she met Walia on 29 December 2021 at Chhatarpur metro station in Delhi. According to the complaint, Walia made him sit in the car and gave him a drug addiction drink. The woman had said in the complaint that when she became insensible, Captain Walia took her to a deserted place and raped her there. On this complaint, Captain Walia’s lawyer told the Supreme Court that the retired army officer had received honors. He has also written 5 Bestseller books. Walia’s lawyer told the court that the woman had already filed a case of rape and molestation on many people.
