New Delhi. Muslim organization Jamiat Ulema-e-Hind has now moved the Supreme Court against the local court order for survey of Jama Masjid located in Sambhal, UP. Jamiat Ulema-e-Hind has filed a petition in the Supreme Court. In its petition, Jamiat Ulema-e-Hind has argued that the Places of Worship Act was enacted in 1991. Despite this, many courts are ordering surveys of religious places. Jamiat has termed this as wrong and said that the Places of Worship Act should be fully implemented. Jamiat Ulema-e-Hind had earlier also filed an application in the Supreme Court on the Places of Worship Act. He has also demanded an early hearing on this.
The Places of Worship Act was passed by the Congress government of Narasimha Rao. It has been said in this Act that the condition of the religious place as it was on August 15, 1947, will be kept the same. No changes can be made in it. Ayodhya’s Babri Masjid-Ram Janmabhoomi issue was kept out of the Places of Worship Act. Last year itself, the Varanasi court had ordered the Court Commissioner and then the ASI survey of Gyanvapi Masjid. Even the Supreme Court did not ban this survey. The Supreme Court and the Court of Varanasi said that there is no provision to ban the survey under the Places of Worship Act. After this, the issue of Shahi Idgah Mosque and Shri Krishna Janmabhoomi in Mathura also started being heard in the court.
On November 19, 2024, Hindu side’s lawyer Vishnu Shankar Jain applied for a survey in the local court of Sambhal, claiming that there was Shri Harihar Temple instead of Shahi Jama Masjid. On which the court ordered the survey on the same day. After this, the survey was conducted the same evening. Last Sunday, when the survey of Shahi Jama Masjid of Sambhal was being conducted, a crowd gathered and then there was a lot of violence. Four people were shot dead in the violence. Police have so far arrested 27 accused in this case. Whereas, 100 have been identified. Police has also sent a notice to Sambhal MP Zia ur Rehman Burke making him an accused. The police has also written the name of the local MLA’s son in the FIR. The police have accused Burke and the MLA’s son of inciting the mob to commit violence.
