New Delhi. The Allahabad High Court has not considered the royal Idgah as a disputed structure in the Sri Krishna Janmabhoomi and the royal Idgah dispute case of Mathura. The Hindu side had demanded the royal Idgah to be declared a disputed site, but the High Court dismissed the petition. The Hindu side had claimed in its petition that the ancient temple situated on the birthplace of Shri Krishna was broken and the royal Idgah was constructed there. The court said that on the basis of existing facts and petition, the royal Idgah cannot be declared a disputed structure at present.
The order was reserved by High Court Judge Ram Manohar Narayan Mishra on 23 May after a debate on the petition of Hindu party Mahendra Pratap Singh. Mahendra Singh had claimed the books of history written in the time from Masir -e Alam Giri to FS Grouse, who was the collector of Mathura, claimed that the Shahi Idgah has been constructed by breaking the temple. The Hindu party also said that no such evidence has been presented by the Muslim side in the court to prove that the mosque is already there. Even in Khasra Khatauni of that land, the mosque is named and there is no record in the Municipal Corporation. No tax is being paid. Moreover, a report of power theft has also been registered against the royal Idgah management committee.
According to the Hindu side, this case is similar to the Sri Ram Temple in Ayodhya and the Babri Masjid dispute. The court had considered Babri Masjid as a disputed structure before the court pronounced its verdict in the Ayodhya case, so the Shahi Idgah Mosque should also be declared a disputed structure. However, the Muslim side has strongly opposed all these arguments, claiming that the royal Idgah has not been constructed by breaking any temple.
