Rape is one of the most heinous crimes against women, but some people are using the legal provisions related to it as a weapon to unnecessarily harass the male partner, the Delhi High Court has said while quashing the FIR lodged against a man. I do.
A man had moved the court seeking quashing of an FIR lodged against him for sexually assaulting a woman he was in a relationship with. The High Court said that the FIR is based on later views.
The court said that the recordings, WhatsApp chats and statements recorded before the magistrate clearly established that there was no evidence to prove rape as the man and woman had consensual physical relations and did so on false promise of marriage. Didn’t happen.
Justice Chandra Dhari Singh, in a recent statement, said, “It is true that the provision under which the FIR has been lodged is one of the most heinous crimes against women. However, it is also an established fact that some people use it to punish their men. Use it as a weapon to harass the partner unnecessarily.”
The court said that this case is a unique example of how an innocent person has to face undue hardship due to misuse of a penal provision and therefore, the court feels that even if the case continues to be heard, nothing in the case Will not come out.
The man’s counsel said that the petitioner and the complainant were previously in a relationship and had consensual physical relations.
The lawyer said that due to some dispute the accused and the woman did not marry each other and later a case of rape was registered against him.
However, the prosecutor opposed the plea to quash the FIR and said that there were serious allegations against the petitioner and the complaint clearly proved that he had sexually assaulted the woman.
