New Delhi. The Supreme Court has taken a tough stand against the Punjab government in the case of not giving benefit of 30 -year -old pension scheme. In this case, the Supreme Court has given a contempt notice to the Chief Secretary KAP Sinha while reprimanding the Punjab government. The Supreme Court will now hear the pension issue on 24 March. The Supreme Court, while pulling the Punjab government, said that it did not implement the Punjab privately managed affiliated and aided college pension benefit scheme 1996 even after the order. The Supreme Court said that the Punjab government has completely misled the court. The Supreme Court reprimanded the Punjab government and said that its AAG had said that the scheme would be implemented. The benefit of the pension scheme was not given in the Punjab and Haryana High Court despite continuously saying such a thing.
The Supreme Court has summoned the reply from Punjab Chief Secretary KAP Sinha.
The Supreme Court has issued a notice to the Chief Secretary of Punjab under contempt asking why action should not be taken against them. The court has also given notice on the issue of giving false affidavits to the Public Education Director of the Punjab Government, who has seen the case of colleges. The Supreme Court also said that it does not believe in the argument of the Punjab government that the statement of AAG has not been given from her side. Earlier, the Supreme Court had found that the Punjab and Haryana High Court had said in the 2002 order that the AAG has said that the pension scheme will be implemented by 15 June 2002 on behalf of the state government.
The Supreme Court said that now the state government is putting this issue on the executive and it is not valid. The Supreme Court said that if the Punjab government takes this attitude, then the court has difficulty in accepting the statement of their legal officers. The Supreme Court said that the courts will then ask for 6 affidavits on every statement. The court asked the Chief Secretary of Punjab to appear in the next hearing and tell that the state government is going to give pension to the petitioners or to take forward the court contempt proceedings.
