The Supreme Court on Monday sought a response from the Bihar government on the PIL challenging the appointment of Bihar Public Service Commission (BPSC) Chairman Parmar Ravi Manubhai.
Justice P.S. A bench of Narasimha and Justice Manoj Mishra noted the pleas of lawyer and petitioner Brajesh Singh, who challenged Manubhai’s appointment as the head of the commission.However, the bench criticized that the petition has been filed by a lawyer who has no connection with BPSC functioning.
The bench issued a notice to the state government and the BPSC president, saying, “As a lawyer you should stay away from filing such PILs like this because you have nothing to do with BPSC or nothing.”
The bench has also appointed a judiciary to hear the PIL.
In the petition, challenging the appointment made on March 15, 2024, it was said that it is against the constitutional order to appoint people with “impeccable character” as the chairman or member of the Public Service Commissions.
According to the PIL, Parmar is an accused in the alleged corruption case filed by the Bihar Vigilance Bureau and the case is pending before a special judge in Patna.
The petition stated, “The defendant number two (Parmar) are facing serious allegations of corruption and forgery and thus their honesty is under suspicion, so he should not have been appointed as the President of BPSC. ”
The petition claimed that Parmar does not meet the basic eligibility criteria for appointment to the constitutional post of the president, as he is not a person with an impeccable character.
