The Supreme Court on Thursday directed the Uttar Pradesh government to provide the medical and magisterial inquiry reports related to the death of gangster and leader Mukhtar Ansari to his son by March 28, 2024.
A bench of Justices Hrishikesh Roy and SVN Bhatti considered the arguments of senior advocate Kapil Sibal appearing for Omar Ansari. Omar said that the medical and judicial investigation reports related to his father’s death were not submitted by the state government.
63-year-old Mukhtar Ansari, a five-time MLA from Mau Sadar, reportedly died of a heart attack on March 28, 2024 in a hospital in Banda, Uttar Pradesh.
Mukhtar, who was in jail since 2005, had more than 60 criminal cases pending against him and was convicted in the murder of BJP MLA Krishnanand Rai.
Before his death, the son had moved the top court in December, 2023, fearing danger to his life and sought a direction to transfer his father to some other jail outside Uttar Pradesh.
The state government had assured the bench in 2023 that if necessary, it would strengthen the security of Ansari inside the Banda jail so that no harm comes to him.
On Thursday, Additional Solicitor General KM Nataraj, appearing for the Uttar Pradesh government, said that documents would be provided to Omar.
The bench noted that Ansari’s postmortem was conducted and later a magisterial inquiry was also conducted.
It asked the state government to provide copies of the medical and investigation reports to Omar within two weeks, who could then file its reply within three weeks.
Omar’s plea said that when his mother approached the Allahabad High Court for Ansari’s security, the court had ordered enhanced security for him in May 2024.
At the time of Ansari’s death, his brother and Ghazipur MP Afzal Ansari had alleged that Mukhtar was being given “slow poison” in jail. The officials had denied this allegation.
