New Delhi. Today, the Supreme Court has given a big relief to Vibhav Kumar, accused of assaulting Aam Aadmi Party’s Rajya Sabha MP Swati Maliwal. The apex court granted bail to Vibhav Kumar, although some conditions have also been imposed. The bench of Justice Suryakant and Justice Ujjal Bhuiyan said that according to the medical report, the complainant’s injuries are simple and the accused has been in jail for more than 100 days. This case is likely to take some time as more than 51 witnesses are yet to be questioned. In such a situation, the accused cannot be kept in custody any longer. The Supreme Court directed to record the statements of important witnesses in the lower court within 3 months.
ASG SV Raju, on behalf of Delhi Police, opposed Vibhav’s bail and said that there is a possibility of tampering with the evidence. To this, the Supreme Court bench replied that you do not have to oppose the bail here but have to balance both. Vibhav Kumar was arrested by Delhi Police on 18 May.
Bail has been granted with these conditions-
According to the court order, accused Vibhav Kumar will be barred from visiting Delhi CM Arvind Kejriwal’s house and office. Vibhav Kumar should not be given the position of CM’s personal secretary or any such position through which he can influence the case. Along with this, the court has also banned Vibhav Kumar and people associated with Aam Aadmi Party from making any kind of statement related to the case.
This is the whole matter-
AAP MP Swati Maliwal had lodged a complaint with the Delhi Police that on May 13, Delhi CM Arvind Kejriwal’s PA Vibhav Kumar misbehaved and assaulted her at his official residence. Swati had said that Vibhav abused me without any provocation and slapped me repeatedly. He hit me on my chest, face, stomach and lower part of my body. The police also got Swati medically examined at Delhi AIIMS, which confirmed the injury. After this, Vibhav Kumar was arrested.
