A district court in Varanasi has dismissed a petition seeking to transfer the original knowledge of 1991 to another court from the Civil Judge’s court.
Advocate Vijay Shankar Rastogi, the party’s party, said that District Judge Jai Prakash Tiwari on Monday dismissed the transfer application saying that the petitioner was not a party in the original trial, so he has no legal basis for demanding such transfer.
The petition has been filed by Manikuntala Tiwari, Neelima Mishra and Renu Pandey. He is the daughters of late Harihar Pandey, one of the litigants who filed the original lawsuit.
According to Rastogi, the petition stated that he is not being given enough time to present his case in front of the Civil Judge (Senior Division) Fast Track, where the original trial has been pending since 1991 and the case has been demanded to be transferred to another court.
Rastogi argued that the three sisters were not listed as party in the 1991 trial, so they did not have the right to file a transfer application.
After hearing the arguments of both the parties, the District Judge rejected the application as non-non-compliant. The original case of 1991 is related to the dispute of the Gyanvapi Mosque complex adjacent to the Kashi Vishwanath temple.
