Guwahati. The coming days may become a matter of great difficulty for Congress MP and Leader of Opposition in Lok Sabha, Rahul Gandhi. In the case registered against Rahul Gandhi in Pan Bazaar police station of Guwahati, Rahul Gandhi can not only be arrested but can also go to jail! Actually, the FIR lodged by Monjeet Chetia against Rahul Gandhi is under non-bailable and serious sections. At the inauguration of the new headquarters building of Congress on Kotla Road in Delhi, Rahul Gandhi had said that BJP and RSS have captured every institution. Rahul Gandhi had further said that now we are fighting against BJP, RSS and Indian State. This statement has created problems for Rahul Gandhi.
Monjeet Chetia has filed a case under section 152 and 197(1)D of BNS on Rahul Gandhi’s statement of fighting the Indian State. Both these sections are cognizable and non-bailable. A case is registered under these sections for endangering the sovereignty, unity and integrity of India. When Guwahati Police will present the FIR in the court, Rahul Gandhi will have to appear there and then the court will decide whether to give bail to Rahul Gandhi and further hearing on giving such a statement or send him to jail. In fact, the FIR states that Rahul Gandhi crossed the limits of freedom of expression and created a serious threat to public order and national security. The FIR further states that by declaring war against the Indian state, Rahul Gandhi deliberately tried to incite subversive activities and rebellion among the public.
It has also been said in the FIR registered against Rahul Gandhi that this is an attempt to disobey the authority of the state. This could create a dangerous narrative. It is further written in the FIR that Rahul Gandhi’s statement can incite unrest and separatist sentiments. Monjeet Chetia alleges that as the leader of the opposition, Rahul Gandhi’s responsibility is to maintain public trust in democratic institutions, but he misused the platform to spread lies and incite rebellion. Let us tell you that Rahul Gandhi is already facing defamation cases in the Savarkar and Modi surname case. Gujarat’s lower court and High Court had also sentenced him in the Modi surname case. Due to which Rahul Gandhi’s Parliament membership ended. Later, on appeal in the Supreme Court, the sentence was stayed. Rahul Gandhi has also apologized once in the Supreme Court due to misrepresentation in the Rafale case.
