New Delhi: The Supreme Court on Thursday directed the Center and the Indian Air Force not to free the woman officer from service who were part of ‘Operation Balakot’ and ‘Operation Sindoor’, but were refused to pay permanent commission. A bench of Justices Suryakant and Justice N. Kotishwar Singh has sought a response from the Center and the Indian Air Force on the plea of wing commander Nikita Pandey, who described not being given permanent commission as discriminatory.
‘Army is a big property for the country’
The bench described the Indian Air Force as a professional force and said that uncertainty in service is not a good thing for such officials. Justice Kant said, our Air Force is one of the best organizations in the world. The officials are very commendable. The kind of coordination he has shown is unmatched. So we always salute them. They are very large assets for the country. In a sense, he is the nation. It is because of them that we are able to sleep at night.
The bench said that the difficult life for the ‘Short Service Commission’ (SSC) officials had started after their recruitment, which was asked to give them some incentives after 10 or 15 years to give permanent commission. Justice Kant said, “This feeling of uncertainty cannot be good for armed forces.” This is a suggestion of the common man, because we are not experts. There can be no compromise on minimum criteria. ”
What is the case of Wing Commander?
On behalf of the female officer, Senior Advocate Maneka Guruswami said that her client was an expert fighter controller, who participated in the Integrated Air Command and Control System (IACCS) as an expert, who was deployed for ‘Operation Sindoor’ and ‘Operation Balakot’.
Order not to free wing commander
The bench asked the Additional Solicitor General Aishwarya Bhati, appearing by the Center and the Indian Air Force, the reason for not giving permanent commission to the officer. Bhati said that he himself is from the background of the Armed Forces, so he is familiar with the status of such officers, but he argued that the petitioner was found to be disqualified by the selection board. He said that the officer approached the Supreme Court directly without filing any report and informed the bench that the second selection board would consider their case. The bench ordered Pandey not to be freed from service until further orders and adjourned the hearing for 6 August. (With language inputs)
