New Delhi. In the excise policy case, the Enforcement Directorate (ED) on Wednesday filed an affidavit in the Supreme Court opposing the plea of Delhi Chief Minister and Aam Aadmi Party (AAP) national convenor Arvind Kejriwal in which the Delhi High Court legalized his arrest. The order has been challenged.
ED said in its affidavit that Kejriwal was arrested only after the Delhi High Court refused to grant interim relief. The investigating agency told the apex court that despite being issued summons 9 times, Arvind Kejriwal was avoiding questioning by not appearing before them.
The ED said that during the period of the scam, around 170 mobile phones were altered and destroyed by 36 persons. Delhi Chief Minister Arvind Kejriwal was arrested by ED on March 21 in the excise policy case.
In its reply, ED has also rejected Kejriwal’s arguments in which it has been alleged that by arresting him at the time of elections, an effort has been made to stop him from campaigning and this is against the concept of fair elections. The investigating agency has said that no matter how high a position someone holds, if there is solid evidence against him then he can be arrested and if the plea of the accused is accepted then the politicians involved in the crime will be exempted from arrest. The national convenor of AAP had approached the High Court in view of the ninth summons issued to him by the ED, which the High Court had held valid. In that summons, he was asked to appear before the ED on March 21. He was arrested by ED in the evening of the same day. He is currently in judicial custody in Tihar Jail.
The federal agency alleges that other accused in the case were in touch with Kejriwal to prepare the excise policy, which has now been cancelled. It is also alleged that the accused benefited from this policy and in return paid bribes to the Aam Aadmi Party.
