New Delhi. The Constitution Bench of 7 judges of the Supreme Court has given a historic decision regarding the classification of Scheduled Castes (SC). The Constitution Bench headed by CJI DY Chandrachud gave the decision with a majority of 6:1. The Supreme Court made it clear that the Scheduled Castes notified in the Presidential List can be divided into different categories and the states have full right to do so. After the decision of the Supreme Court, it will be possible for the states to give the benefit of reservation in government jobs and education on the basis of priority to the sub-castes included in the SC category. After the decision of the apex court, the state will be able to give special benefits to the needy living on the margins by classifying the sub-castes. However, Justice Bela Trivedi, who was part of the Constitution Bench, gave her decision different from the majority. She said that the Parliament has the right to divide or regroup the castes notified in the Presidential List, not the state legislatures.
Justice Bela Trivedi said that the state legislatures (Vidhan Sabha and Vidhan Parishad) do not have the right to regroup or subdivide the castes already listed in the SC category. According to the information available on the Supreme Court website, Justice Bela Trivedi was born on 10 June 1960 in Patan, Gujarat. Her father was also in the judicial service, due to which he was transferred frequently. In such a situation, her schooling also took place in different cities. She obtained an LLB degree from MS University of Baroda. After this, she practiced law in the Gujarat High Court for about 10 years. She demonstrated her skills especially in cases related to civil and constitutional disputes.

Name registered in Limca Book
Justice Bela Trivedi was appointed as a judge in the City Civil and Sessions Court of Ahmedabad on 10 July 1995. Incidentally, Justice Bela Trivedi’s father was also posted as a judge in the same court. In the 1996 edition, her name was recorded in the Limca Book of Indian Records. Its subject was – Father and daughter judges in the same court. After about 16 years, Justice Bela Trivedi was made a judge of the Gujarat High Court. She took charge as a judge in the High Court on 17 February 2011.
Responsibility held in various positions
Justice Bela Trivedi had held many important positions before becoming a judge. She has also been the Registrar (Vigilance) in the High Court as well as Law Secretary in the Gujarat Government. Apart from this, she also served as a CBI judge and special judge. She also served in the Jaipur Bench of Rajasthan High Court. Then in February 2016, she was again posted in the Gujarat High Court. While serving in the Gujarat High Court, she was promoted and appointed as a judge in the Supreme Court on 31 August 2021. Justice Bela Trivedi will retire on 9 June 2025.
