Jaunpur. The troubles of Jaunpur’s powerful former MP Dhananjay Singh will increase in the coming days. Allahabad High Court has refused to give immediate relief to Dhananjay Singh. Allahabad High Court has also refused to stay the sentence of Dhananjay Singh without completion of the hearing. The High Court has also rejected the demand of Dhananjay Singh’s lawyers to conduct the hearing without summoning the records of the lower court. The court has summoned the records from the district court of Jaunpur to hear the application of Dhananjay Singh. Allahabad High Court has also sought reply from the UP government in this regard. The UP government will have to file its reply in the High Court by 22 April. The High Court will hear Dhananjay Singh’s application on April 24. Before this, the district court of Jaunpur will have to send the original records related to the case to the High Court before April 24. Dhananjay Singh’s criminal appeal was heard in the single bench of Justice Sanjay Kumar Singh.
However, due to the stand of the High Court, Dhananjay Singh’s hopes of contesting the elections have been dashed. Now, if Dhananjay’s sentence is not stayed in the hearing to be held on April 24, then he will not be able to contest the Lok Sabha elections. On behalf of Dhananjay Singh, the case was mentioned in the court today and a request was made that the case should be heard on the basis of affidavit and certified copy without the records of the lower court. The High Court did not accept this request of Dhananjay Singh’s lawyers.
It is noteworthy that Dhananjay Singh had filed an application in the Allahabad High Court against the seven-year sentence given by the Jaunpur district court. This case could not be heard in the High Court because the case was not taken up on March 20 and April 1. If the 7-year sentence given by the Special Court of Jaunpur is not stayed, then Dhananjay Singh will not be able to file nomination in the Lok Sabha elections. Dhananjay has filed a criminal appeal against the 7-year sentence given by the Special MP MLA Court of Jaunpur.
In the appeal, a request has been made to cancel the sentence and release him on bail till the verdict is announced. Along with this, a request has also been made to put the punishment on hold until the final decision of the court. In such a situation, only if the court stays the punishment till the verdict is given, then only Dhananjay Singh will be able to contest the Lok Sabha elections. Due to 7 years of imprisonment, Dhananjay Singh cannot contest elections right now. In fact, under the People’s Representation Act, a person sentenced to more than 2 years cannot contest elections. On March 6, Jaunpur court had sentenced Dhananjay Singh to 7 years imprisonment. In the kidnapping case, Dhananjay was found guilty and the punishment was announced.
