The by-election for Akola West assembly seat in Maharashtra was scheduled to be held on April 26 but now the by-election has been banned. In fact, the Election Commission has decided to ban the by-election on this seat because the new member who wins this seat will get less than a year’s time. Bombay High Court has said that by-election cannot be held on this seat.
Let us tell you that the Gazette notification regarding the nomination process for the election for this assembly seat was issued on Thursday itself and the by-election here was to be held on 26th April and the result of the election was to be declared on 4th June. Now the Election Commission says that following the instructions of Nagpur Bench of the High Court, the notification of by-election on Akola West seat is being cancelled.
High Court banned
The bench of Justice Anil Kilor and Justice MS Jawalkar had said on Tuesday itself that no by-election will be held on Akola West Assembly seat. The court had said that this is a violation of Section 151 (A) of the Representation of the People Act. Let us tell you that Akola West Assembly seat had become vacant due to the death of outgoing MLA Govardhan Sharma. He was a BJP leader and died on November 3, 2023. The court says that by-elections will not be held on this seat which became vacant due to his death because whoever wins this seat will get less than a year.
Application was given in court
The court gave this direction during the hearing on a petition, in which the petitioner had said that assembly elections are to be held in Maharashtra soon, hence holding by-elections is a waste of money. Along with this, the petitioner had also said that after the results are declared on June 4, the MLA will get only four months to work.
