Ajmer. The court has acquitted six accused including Maulvi Gauhar Chishti for raising slogans of ‘Sir Tan Se Juda’ at the Sufi Saint Khwaja Moinuddin Hasan Chishti Dargah. Ajmer Dargah police station could not present the necessary evidence in the court. Many serious flaws came to light in the investigation. The trial went on in the court for 2 years. 22 witnesses and 32 documents were presented. The case was registered in June 2023 at the Dargah police station.

Government lawyer Ghulam Nazmi Farooqui says that the court has not given out the entire judgment, it has only announced it. All the six accused have been acquitted in all sections. After seeing the full judgment, we will appeal in the High Court. The evidence presented by the police in the court was not considered sufficient. On this basis, the court acquitted the six accused. The question arises that what legal options does the Rajasthan government have in this case. In this regard, News 18 spoke to Ajmer’s senior lawyer Jaiprakash Sharma.

Taking advantage of the experience of senior lawyers, seriousness should be maintained in the case
According to Sharma, ‘If the then government wants effective advocacy in such serious crimes, then seriousness should be maintained in the case by taking advantage of the experience of a senior lawyer. There have been many such examples in the past too that the state government has called a senior lawyer on its behalf to advocate in a case as a special public prosecutor. The public prosecutors of the ADP level have also been instructed for advocacy. For example, recently a case of blackmailing is going on. The public prosecutor of the concerned court does not advocate in it. An ADP level officer comes and advocates the case. He had a good experience of advocating on behalf of the prosecution. If he had been included in the case, the decision would have been different.’

There is definitely some hope if an appeal is made in the High Court
He further said, ‘The evidence presented in the court is not admissible in the eyes of law. There is some hope if an appeal is made in the High Court. The Additional Public Prosecutor will prepare his report and give it to the prosecution department. The District Magistrate will consider it. He will take opinion from the Law Department. After this, the application will be sent to the Home Department. Then the appeal will be filed in the High Court.’
