Jaipur. The Rajasthan Real Estate Regulatory Authority (RERA) has issued a major and strict order in favor of flat buyers in a residential project called ‘premises’. The Authority has directed the builder, M / s SSBC Dream Home LLP to return the full amount of their deposits to the customers with interest. it Decision All those homes have emerged as a great hope for buyers, who are falling prey to the arbitrariness and delay of the builders. The case is related to the complaint filed by Sunil Kumar Tandi and other buyers against the builder (number: Raj-Rera-CN-2025-7835). The complainants told the authority that they had paid ₹ 12,06,000/- out of the total sales amount of ₹ 13,99,000/- for flat number E-211, which is 86% of the total amount. The Agreement to sell between him and the builder on November 15, 2019. As per the agreement, the occupation was to be given by August 27, 2021, but the builder failed to do so.
The complainants alleged that the builder has been using their deposits for the last 5 years. He demanded to return his entire deposit with interest and fine. On this, the builder said in his reply that the construction of Block B and C has been completed. He also said that 95% of the complainant’s flat (E-211) construction work has been completed and internal work will be completed by October 2025. The builder also said that if the buyer wants, they can be given another flat for the temporary residence, or their deposit will be returned.

The authority also found that the project is listed in the “lapsed” category on RERA’s website. The most important thing is that no valid completion or occupancy certificate has also been received so far.
RERA in his order made it clear that an allocation has the full right to ask for a refund in the event of the promoter’s mistake. Therefore, the authority directed the builder to return their entire deposit ₹ 12,06,000/- to the complainants. Apart from this, the builder will also have to pay interest at the rate of 10.90% from each deposit date to refund. The Authority has excluded the Moretorium period from August 28, 2021 to August 26, 2022 with a delay of interest. It is mandatory to follow this order within 45 days.
