New Delhi . The Delhi High Court has refused a hearing on the PIL filed for the Gurjar community in the Indian Armed Forces demanding the formation of a regiment for the Gurjar community. The Delhi High Court has also reprimanded the petitioner for filing a petition for such demand.
The Delhi High Court dismissed the petition and asked which law or constitution has such a petition filed. At the same time, the bench also said whether any such right has been given in the law or constitution, under which you are demanding to create such a regiment in the army.
In fact, a PIL was filed in the Delhi High Court, demanding that a regiment should be formed for the Gurjar community in the Indian Armed Forces. However, a bench of Delhi High Court Chief Justice DK Upadhyay and Justice Tushar Rao Gedela dismissed the petition.
The petition said that the formation of the Gurjar Regiment will strengthen the Indian Army and historically the warrior community will benefit from recruitment.
The petition also said that the Gurjar community lives in strategic border areas like Jammu and Kashmir, Rajasthan, Himachal Pradesh, Punjab and Uttarakhand, where they have played an important role in defense of India. The Gurjars actively participated in the freedom struggle of 1857, where they revolted against British rule in many areas including Meerut, Bulandshahr, Muzaffarnagar and Rajasthan. The British colonial records also have evidence of Gurjar warriors raising their voice against the British Army.
To this, the bench said, “Such a petition has been filed under which law or constitution rights. Is there any right in the law or constitution, under which you are demanding to make such a regiment in the army.”
However, the bench later said that he was told by the petitioner’s counsel that he wanted to withdraw his petition. Therefore, it is dismissed on the basis of withdrawal of the petition.
