According to the news, the bench accepted the appeal of Singh and SpiceJet challenging the single judge order passed on July 31, 2023 and sent the matter back to the concerned court for fresh consideration of the petitions challenging the arbitration tribunal. In this context, Maran and his company KAL Airways have decided to challenge the decision after consulting their legal advisor. Assessment of FTI Consulting LLP of UK
KAL Airways said in a statement on Monday that they are also seeking damages of more than Rs 1,323 crore. This has been determined by Britain’s FTI Consulting LLP. It is a well-known company for assessing damages caused by breach of contract. According to the statement, the claim for damages was presented by KAL Airways and Maran before the arbitration tribunal. It has always remained an integral part of justice.
The statement said that a fair and equitable resolution of the matter is expected by pursuing both the challenge to the Delhi High Court’s decision and the claim for damages. It said that the dispute arose due to SpiceJet’s breach of trust and has caused problems for both KAL Airways and Kalanithi Maran for more than a decade.
