Jaipur. A 9 MLD capacity sewerage plant at Balotra, Barmer may fall on the Directorate of Autonomous Government (DLB) and former and current officials of RudsiCo. Because these officers had blacklisted the contractor first due to the sewerage treatment plant properly maintained and not operating, the order to seize his security amount, the Ernest Money and apply a penalty and issued an order to get the outstanding work done by another contractor on his risk and cost. When the contractor approached the court, DLB officials canceled the order to blacklist the contractor firm. Also, he applied to the court to withdraw his case.
Now the court has dismissed the contractor firm’s application and the basic suit with a cost of 20 lakh rupees. Along with this, the Chief Secretary has sent a copy of the order and asked to investigate whether there is any immoral connivance between the contractor firm and DLB-RudsiCo officers. Along with this, the court has ordered the Executive Director of Rudsico to submit the original file related to cancellation of the said contractor firm in the court.
This was given by Judge Dinesh Kumar Gupta of Commercial Court No. 1 Order M / s NVrad Project Pvt. Ltd. Kanpur vs Hridesh Kumar Sharma, the then Director and Joint Secretary, Manoj Soni, the then Project Director Rudisko, Sumitra Jain Chairman Municipal Council Balotra and Jodharam Vishnoi in the case of the then Commissioner Municipal Council Balotra.
Know what is the whole matter:
In Balotra town, 9 MLD capacity sewerage treatment plant was designed and built for 10 years of operation and maintenance. This tender was approved in favor of the applicant contractor firm. After the contract was signed, a work order was issued in favor of the contractor firm. On this, the contractor firm completed the work of sewerage treatment plant on 15 December 2015. His Defect Liberation Period also ended on December 18, 2016.
After this, Rudsico and DLB also issued an order of operation and maintenance of the plant. Which was to start from December 19, 2016 and was to be completed on December 18, 2026. But, The then Director and Joint Secretary Hripesh Kumar Sharma On September 21, 2022, the contractor was blacklisted to the firm, saying that the operation and maintenance of the sewerage treatment plant is not being done properly. It was said in this order that along with seizing the security amount of the contractor firm, the seizure of the Ernest Money, the action will be taken separately to impose penalty and get the outstanding work done by another firm on its risk and cost.
Despite court stay, new tenders were made:
The order to blacklist was challenged by the contractor firm in the Commercial Court and sought interim relief. On this, the court said in an interim order passed on October 11, 2022 after hearing that the order to black list should be kept in the status quo in relation to 21-9-2022 and no further proceedings should be taken till the next date. After this, the court accepted the application of temporary prohibition on 16-11-022 that the security amount of the applicant firm, the Ernest Money should not be seized till the decision of the original claim. Also, he should not be stopped from participating in tenders. Despite this, officials of Rudsico and DLB demanded online tenders for repair, inspection, operation and maintenance of the said sewerage treatment plant.
Officers of such trapped DLB and Rudsico:
Despite the court stay, the contractor firm presented Istagasa in the court against the then DLB Hridesh Kumar Sharma, PD Manoj Kumar Soni, Balotra Municipal Council Chairman and Commissioner through its representative on the repair, inspection and tender of the sewerage treatment plant. With this, these officers felt that they could get trapped, the court order could come against them, so on March 17, 2025, the order of September 21, 2022, who blacklisted the contractor firm, canceled the order of September 21, 2022. The contractor filed the firm to withdraw the case from the court.
Therefore, there is a possibility of connivance between contractor firms and officers:
When the contractor firm applied to withdraw the case from the court, there was no protest by DLB, Rudsico and City Council Balotra. The fact also came to light that the contractor was rejected on December 7, 2024 due to non -presenting evidence of the firm. After this, DLB-Rudcico could be implemented by blacklisted.
It also feared that somewhere these officers have not been losing the government treasury by not recovering the security amount, the amount of crores of rupees received from seizing the Ernest Money and the penalty. Why is an amount of Rs 5.50 crore not being recovered from the contractor firm to complete the outstanding work. The order canceling the order that blacklisted the contractor was sent from the Secretary of Government to all the high officials per Chief Government, then why he did not take any action in the matter.
