Ahmedabad. Referring to the case related to the attack on foreign students in a university hostel in Ahmedabad, the Gujarat High Court on Monday said that it should not be made an investigating agency and not every incident is such that a PIL should be filed. Chief Justice Sunita Agarwal and Justice Aniruddha P. Mayi refused to take suo motu cognizance of the incident and said the police would investigate the matter.
The court made these comments after a lawyer requested to accept the case as a suo motu public interest litigation. Chief Justice Aggarwal said, “Our effort is that justice should be done, but we should not be made an investigating agency. We don’t do this. We still want to remind ourselves that we are constitutional courts. If such a case comes, we will definitely take cognizance, but this is not one of them.”
He said that not every incident in the city is such that a PIL should be filed. Justice Aggarwal said, “Do not make this court an alternative to police inspectors. Don’t make us police inspector. We are not investigating officers.” When lawyer K. R. Kosti said that the police had not included all the relevant sections in the FIR, so the court advised him to adopt legal remedies.
Meanwhile, the police arrested three more people on Monday in connection with the attack on foreign students. The crime branch gave this information. The city crime branch on Sunday arrested two persons, Hitesh Mewada and Bharat Patel, and handed them over to Gujarat University police station for legal process, a release said.

Police had said that two students from Sri Lanka and Tajikistan were admitted to the hospital after the incident of assault with foreign students in the A-Block hostel. Police said that an FIR has been registered against 20-25 unidentified attackers and nine teams have been formed to investigate the incident. Police said that five people have been arrested so far in connection with the incident.
