The Supreme Court has rejected all the petitions demanding matching of every vote of EVM with VVPAT slip. The bench of Justice Sanjeev Khanna and Justice Dipankar Dutta on Friday gave its verdict on the petition regarding 100 percent matching of EVM and VVPAT. This bench had reserved the decision on April 24 after hearing the arguments of all the parties. Voting for the second phase of Lok Sabha elections 2024 is going on. Meanwhile, the Supreme Court has continued the old system while giving its verdict on the petition regarding matching of Voter-Verifiable Paper Audit Trail (VVPAT) slips with the votes cast through Electronic Voting Machine (EVM).
This decision of the Supreme Court has made it clear that when the votes for the Lok Sabha elections 2024 are counted on June 4, not every vote of the EVM will match with the VVPAT slips. Let us tell you that many organizations had filed this petition demanding matching of EVM and VVPAT slips. The court had reserved the decision after taking cognizance of the answers to the questions raised before the Election Commission. There was a demand on behalf of the petitioners that to maintain the confidence of voters on EVMs, 100 percent counting of VVPAT slips should be done.
Court asked five questions
Describing EVMs as completely safe, the Election Commission said that VVPAT slips are very small and fine. The court had also commented during the hearing that one cannot express disbelief in everything. A bench of Justices Sanjiv Khanna and Dipankar Dutta had asked an Election Commission official five questions regarding the functioning of the EVMs, including whether the ‘microcontroller’ installed in the EVMs could be reprogrammed. Yes or No. Senior Deputy Election Commissioner Nitish Kumar Vyas, who appeared in the court, had earlier given a presentation in the court about the working of EVMs. The bench had called him to answer questions at 2 pm.
Clarification needed on some aspects
The Supreme Court bench had said during the hearing that it needed clarification on certain aspects as there was some confusion regarding the answers given on the ‘Frequently Asked Questions’ (FAQs) regarding EVMs. The bench had said that we have some doubts and need clarification and hence we have listed the matter for directions. He said that we do not want to be factually wrong in our conclusions, but want to be absolutely sure.
