Varanasi. The matter of Gyanvapi Masjid of Varanasi, UP is hot these days. The Hindu side has given 11 applications in the court. Apart from this, an application has also been given in the Allahabad High Court on this issue. Nowadays, during the hearing of these applications, there is a big discussion of two rules. The Muslim side has challenged the application of the Hindu side under Order 7 Rule 11 of the Code of Civil Procedure 1908. Whereas, the Hindu side has raised the issue of Order 26 Rule 10 of the same procedure i.e. Civil Litigation Code. The Supreme Court has directed the District Judge of Varanasi to first hear the application of Order 7 Rule 11. So let us tell you what these two rules of the Civil Litigation Code say after all.
Order 7 Rule 11 of the Civil Litigation Code deals with the relevance and maintainability of a petition. Under this, an application is made against any suit and a request is made to not hear that suit and set it aside. Under this provision, the petitioner has to tell on what grounds the suit should not be heard and it should be considered liable to be dismissed. On the Gyanvapi issue, the Muslim side says that under the Places of Worship Act of 1991, it is a matter of keeping the shrine as it was on the day of independence in 1947. In such a situation, the petition of the Hindu side to offer prayers at Gyanvapi should be rejected.
It was about order 7 rule 11. Now let us tell you that what is the issue of Order 26 Rule 10 of the Civil Litigation Code which has been raised by the Hindu side. Under this rule, when there is a problem in the scientific examination of any site or matter, then for the sake of justice, there is a matter of conducting a survey by forming a commission. On the basis of this, the Hindu side had obtained permission from the court of Civil Judge Senior Division for the survey of Gyanvapi Masjid. The survey report has been submitted to the court. The Hindu side has also mentioned this rule in front of the district judge and demanded that before hearing the application of the Muslim side, the report, photo and video of the court survey must be seen. The court has fixed the date for tomorrow i.e. 26 May to decide in this regard.
