On 24 and 25 June, almost all the newly elected Lok Sabha MPs participated in the swearing-in ceremony. Every member took oath in it. Do you know that if a member does not take oath and starts participating in the proceedings of the Lok Sabha and also votes without it, then he can do so but he has to pay a fine for every such day. How much is it?
Question – Under which article of the Constitution is it necessary to take oath?
– Under Article 99 of the Constitution of India, every member of Parliament is required to take an oath before taking his seat in the Lok Sabha and fill and sign the relevant form. This is mentioned in the Third Schedule of the Constitution.
Question – Is the language of the oath fixed? Or can anything else be read as an oath?
– The oath can be taken in 21 languages but its words are fixed. Every MP has to take oath according to this. You cannot say anything of your choice before and after the oath. The sentences and words of the oath are like this
I…..(name) having been elected (or nominated) a member of the House of the People do swear in the name of God/solemnly affirm that I will bear true faith and allegiance to the Constitution of India as by law established, that I will uphold the sovereignty and integrity of India and that I will faithfully perform the duties of the office which I am about to assume.
Question – What happens if an MP uses other words while taking oath, like Owaisi, Chandrakant Gangwar and Pappu Yadav said by some other MPs?
– Any such thing is removed from the proceedings of the Parliament. However, keeping in mind the dignity of the Constitution, no MP should say such a thing.
The swearing in of members is an important occasion. It is expected that nothing should be done by members in the House that may spoil or disturb the solemnity of the occasion.
Question – By the way, does an MP officially become a member of Parliament after taking oath or does he get all the rights of a member as soon as he wins?
– The reality is that the day a candidate wins the Lok Sabha elections, he gets the rights that an MP has. For this, an election certificate from the Returning Officer is required. The Returning Officer immediately sends the report of the results to the Central Government, Election Commission and the Secretary General of the Lok Sabha. But according to the Constitution, it is necessary that after being elected, you take the oath of the House so that you work according to that spirit and act upon it while being aware of your duties.
Question – What happens if a member does not take oath on time?
– He can take oath in front of the speaker anytime during the session. He can even take oath in front of the speaker in his chamber.
Question – Can the oath be taken only in Hindi or in other languages as well?
– Members of Parliament can take oath in English or any of the other 22 languages. All these languages are included in the eighth and third schedules of the Constitution. Apart from English, these languages are Assamese, Bengali, Bodo, Dogri, Gujarati, Hindi, Kannada, Kashmiri, Konkani, Maithili, Malayalam, Manipuri, Marathi, Nepali, Oriya, Punjabi, Sanskrit, Santali, Sindhi, Tamil, Telugu and Urdu. They can also sign in these languages after taking oath.
Question – Can a member participate in Parliament proceedings without taking oath?
– He can take the oath. But without taking the oath, he will have limited rights during the proceedings in the House. He can sit in the House and can also vote. But he will not be entitled to participate in any debate and discussion or make any comment.
Question – What will happen if a member comes and sits in the House or votes without taking the oath?
– He can certainly do this, but for every such day, he will have to pay a fine of Rs 500. This will be considered as a loan and will be recovered from him or deducted from his salary.
