Maternity Leaves Amendments: There is good news for women who become mothers through surrogacy. The government has amended the rules related to maternity leaves and has also included women who become mothers through surrogacy. The Center amended the rules to allow 6 months of maternity leave to women employees in case of surrogacy. Till now, there was no rule to grant maternity leave to female government employees in case of birth of a child through surrogacy.
With this amendment, the Centre has changed a 50-year-old rule under which female government employees can avail 180 days of maternity leave in case of giving birth to a child through surrogacy. As per the changes made in the Central Civil Services (Leave), it has also allowed 15 days of paternity leave to the “commissioning father” in addition to child care leave to the “commissioning mother” (the intended mother of a child born through surrogacy).
In case of surrogacy, the surrogate mother, as well as the commissioning mother with less than two surviving children, may be granted maternity leave of 180 days if either or both are government servants, the Personnel Ministry said in the notification.
