After the hearing held yesterday in the Supreme Court in the matter of Gyanvapi Masjid of Varanasi, it is now being discussed whether it has given relief to the Muslim side or to the Hindu side. Let us first talk about the order given by the bench of Justice DY Chandrachud for the time being. The Supreme Court has said in its order that the district judge of Varanasi will now hear this issue. The District Judge will hear the application of the Muslim side on priority. In this application, the Muslim side has declared the case of the Hindu side as unfit for hearing. The order of May 17 has been kept in force till 8 weeks after the decision of the district judge. So that any party dissatisfied with the decision can try the options of legal relief. Apart from this, there is no restriction on the number of Muslims to offer Namaz or their number in the mosque. Vajukhana will be under security and arrangements for Vaju will be done by the DM.
The court made a very important point during this hearing. The issue of enforcement of the 1991 law relating to shrines was raised in this case by Huzaifa Ahmadi, the lawyer for the Muslim side. On this, Justice Chandrachud clearly said that there is no bar on ascertaining the religious nature of a place under this law. This is being considered as a setback for the Muslim side, as it was demanding the cancellation and disqualification of the suit of the Hindu side under the Religious Places Act itself.
Now we know which side, Muslim or Hindu, benefited from the order of the Supreme Court. Justice Chandrachud talked about maintaining balance with this order. He said that there is no bar on ascertaining the religious nature of the land under the law relating to shrines. This is being considered a setback for Muslims. Under this order, the survey has also not been told wrong and the doors of more surveys have been opened in future. Apart from this, the ban on the use of Vazukhana has also been maintained. This has also shocked the Muslim side. The case has been referred to the District Judge and it has been asked to dispose of the application of the Muslim side first. This benefits the Muslim side. However, the Hindu side has expressed happiness over the order of the Supreme Court.
