Maharashtra In a major relief to the political party Nationalist Congress Party (NCP) and its chief Sharad Pawar, the country’s top court has given permission to use the name of the party NCP-Sharadchandra Pawar in the Lok Sabha and Assembly elections. It is clear that now Sharad Pawar’s party will contest with a new name in the 2024 Lok Sabha elections. This order of the Supreme Court is being considered a big blow to his nephew Ajit Pawar’s group. Apart from this, the apex court has also given its decision in favor of Sharad Pawar faction regarding the election symbol.
The Supreme Court has ordered the Election Commission to recognize the ‘man blowing trumpet’ election symbol of Nationalist Congress Party – Sharadchandra Pawar. This clearly means that now the Election Commission of India cannot allot this election symbol to any other party. But, do you know how any political party is named? Who recognizes the names of the parties? At the same time, on the basis of what conditions does the Election Commission allot election symbols to political parties? Is it possible that any party can demand the symbol of its choice?
Under which law are political parties formed?
First of all let us understand how a party is registered and how it gets its name? There are rules regarding the formation of political parties in the Representation of the People Act, 1951. If you want to form your own party, then first you will have to register with the Election Commission. According to the rules, the Election Commission issues an online form to form a political party. After filling this form, the person wishing to form a party will have to take a printout and send it to the Election Commission within 30 days along with the necessary documents. Also, a fee of Rs 10,000 will have to be deposited.
The Election Commission forms political parties on the basis of the rules laid down in the Representation of the People Act, 1951.
Party constitution has to be prepared in advance
Before starting the registration process of a political party, it is necessary to prepare the constitution of the party. It should be recorded what will be the name of the political party and its method of working? Along with this, it will also have to be decided in the constitution how the party president will be elected? Apart from this, complete information will also have to be given about those people of the party who will hold important positions. Signatures of all of them will also have to be obtained on the copy of the party constitution. The details of the party’s bank account will also have to be given in the documents.

Who decides what will be the name of the political party?
You will have to decide the name of the political party yourself. However, whether to approve the name given by you or not will entirely depend on the Election Commission. Before approving your suggested name, the Election Commission checks whether the given name has already been given to any other party. If the same name is given to another party, then the election itself may suggest another name to you. If the Election Commission wants, it can ask you for another name for the party.

How many members are required to form a political party?
To form a political party, it is necessary to have at least 500 members. There is also a condition attached to this that no member should be associated with any other political party. For this, the person wishing to form a party also has to give an affidavit. In this affidavit, the applicant will have to confirm that no member of his party is associated with any other political party. Now the question arises that how does the Election Commission allot election symbols to any political party?
Now the Election Commission does not allot election symbols containing lion, elephant or other animals and birds.
How political parties get election symbols
The Election Commission allots election symbols to political parties under ‘The Election Symbols (Reservation and Allotment) Order, 1986’. However, to get election symbols, political parties have to fulfill certain terms and conditions. Let us tell you that more than 100 election symbols remain in reserve with the Election Commission. These symbols have not been given to any party yet. Whenever the time comes to release election symbols, the Election Commission releases one of them for the party. If the party demands a particular symbol, the Commission also considers it.

What kind of election symbols does the Election Commission not give?
If the special election symbol asked for by a political party has not been allotted to any other party, then the Election Commission can issue it to the same party. Let us tell you that there have been controversies regarding election symbols. For this reason, election symbols with photos of animals and birds are no longer given. Animal rights activists had opposed this. In fact, parties used to parade animals and birds with their symbols during the campaign. Animal rights activists had called it cruelty. After this the Election Commission banned such symbols.
