In the Gyanvapi Masjid case, the Varanasi District Court has given the next date after hearing both the sides. Now the matter will be heard on May 26. According to the information received, the court will hear the application of Order 7 Rule 11 of the Muslim side on this day.
Apart from this, the court has also asked both the parties to file an objection on the report of the Survey Commission. Seven days’ time has been given to both the parties for this. At the same time, during the hearing on Tuesday, the National President of Hindu Sena gave an indictment application in the Varanasi District Court. It demanded that the Gyanvapi Masjid be shifted to some other place and the mosque premises be given to the devotees of Lord Shiva for worship.
What is Order 7 Rule 11- It means that instead of hearing a case on the merit of facts, the court decides whether it is worth hearing or not? Also, what the petitioner is demanding, can it be given or not? If the court feels that relief cannot be granted, the demand is dismissed without trial. Apart from this, there are many reasons under Rule 7 on the basis of which the case can be dismissed.
What happened on Monday- Earlier on Monday, the court had heard the demands of both the parties. After completing the hearing on which the decision was reserved. After the hearing on Monday, Sudhir Tripathi, counsel for the Hindu petitioners, said- “We requested the court to allow us to examine the commission’s report and the video taken during the survey as it is evidence in the case. In this regard, we have submitted an application in the court for permission to study the report of the Commission.
On behalf of Musjid, Anjuman Intejamiya’s lawyer Akhlaq Ahmed said- “We filed an application in the court today saying that as per the direction of the Supreme Court, the Varanasi court should first decide on the sustainability of the trial.
