New Delhi. A Delhi court on Wednesday refused to grant interim bail to Chief Minister Arvind Kejriwal. CM Kejriwal had filed a petition in the court for a medical test on the basis of his health and sought interim bail for seven days, which was rejected by the court. Special Judge Kaveri Baveja of Rouse Avenue Court will now hear his regular bail plea on June 7.
CM Kejriwal appeared in court through video conference from Tihar Jail. Judge Kaveri Baveja, while giving the verdict, extended the judicial custody of CM Kejriwal by 14 days. Now he will remain in jail till June 19. Solicitor General (SG) Tushar Mehta and Additional Solicitor General (ASG) SV Raju, representing the ED, had last time said that the bail plea was not acceptable. They had criticized CM Kejriwal’s conduct, citing the ‘misuse’ of interim bail for election campaigning.
Kejriwal’s defence, led by senior advocate N. Hariharan, had claimed that the interim bail plea was necessary due to his diabetes and other health problems. The ED had argued that Kejriwal’s medical test could be conducted in jail. He is accused of trying to avoid surrender. In view of the general elections, the Supreme Court had granted interim bail to CM Kejriwal till June 1. After this, Kejriwal surrendered in Tihar Jail on June 2.
Rouse Avenue Court, while rejecting interim bail plea of Arvind Kejriwal, said….
1. Type-2 diabetes cannot be termed as a disease serious enough to grant interim bail to Arvind.
2. The extensive campaign tours and related meetings/events undertaken by Arvind Kejriwal, as highlighted during the debate, also indicate that he is not suffering from any serious or ‘life threatening’ illness.
3.The applicant seeks interim bail on the grounds of diagnosis of an anticipated illness, which cannot be said to be a valid ground for the relief prayed for.
4. There is no basis for granting the relief sought by the applicant. Therefore, the prayer of the applicant for grant of interim bail is rejected.
5. If considered appropriate by the Director, AIIMS, New Delhi, keeping in view the nature of ailments disclosed by the applicant.
6.The Medical Board, in addition to complying with the earlier order dated 22.04.2024, shall also examine the applicant and prescribe such medical tests as it may deem fit within three days.
7.The jail authorities will ensure that the scheduled tests of the applicant are started without any delay.
8. On receipt of the report, the Medical Board shall prescribe further necessary treatment as required and the jail authorities shall ensure that the treatment prescribed by the Medical Board is provided to the applicant immediately under informing this Court.
