New Delhi. A case has come to light of a civil judge of Mumbai conducting a hearing in the court premises under the influence of alcohol. Considering the seriousness of the matter, his petition in the Bombay High Court has been rejected by the accused judge. The said judge had approached the High Court and appealed to be reinstated. While refusing to grant him relief, the court said that judges should work with dignity and should not indulge in such conduct or behavior which would affect the image of the judiciary.
The 52-year-old civil judge had filed a petition in the High Court challenging his removal from the post of Civil Judge Junior Division due to alleged inappropriate behavior and coming to the court several times in an inebriated state. The judge had challenged an order passed by the Law and Judiciary Department of the Maharashtra government in January 2022, in which he was removed from judicial service. The order was passed after a report was submitted by the Principal District and Sessions Judge, Nandurbar.

The High Court bench comprising Justice AS Chandurkar and Justice JS Jain rejected the petition saying that the order of his removal did not seem perverse. The bench said, “It is a universally accepted norm that judges and judicial officers should function with dignity and should not indulge in such conduct or behavior which is likely to affect the image of the judiciary or which is discreditable to the judicial officer.” Be indecent.” It states that if members of the judiciary engage in conduct that is scandalous or unbecoming of a judicial officer. Courts cannot give any relief in this.
