Bangalore. A special division bench of the Karnataka High Court has dismissed the petitions of college girls seeking permission to wear hijab in classes and directed that the government should complete the probe into the “unseen elements” who are behind taking up the matter. Chief Justice Ritu Raj Awasthi, Justice Krishna S. Dikshit and Justice Jayabunnisa Mohiuddin Khaji, “we are disappointed as to how this suddenly became an issue in the middle of the academic period.”
The order stated that the manner in which the hijab controversy has unfolded, gives scope for the argument that some ‘unseen hands’ or ‘unseen elements’ are working to create social unrest and disharmony.
The court order said, “Much much needs to be specified. We are not commenting on the ongoing police investigation, lest it be affected. We have seen the copies of the police papers given to us in a sealed cover.” We hope that the matter will be investigated promptly and effectively and the guilty will be punished without any delay.”
The order of the bench further said, “From the submissions on behalf of the Respondent, Pre-University College at Udupi and the material placed on record, we see that all was well with the dress code from 2004 onwards.”
“We are also impressed that Muslims also participate in the festivals celebrated in the ‘Ashta Matha sect’ (Udupi is the place where the eight monasteries are located),” the bench said.
The court, while rejecting the petition of the girl students, said that hijab is not a mandatory part of religion. Students in school-college cannot refuse to wear uniform. The court has said that the obligation regarding the school uniform is a proper management. The student or student cannot deny it.
Let us tell you that on February 9, a larger bench was constituted to hear the matter. A petition was filed on behalf of the girls demanding that they be allowed to wear the hijab even in the classroom, as hijab is an essential part of their religion.
However, the special bench earlier in the day dismissed all the petitions seeking permission to wear hijab in classes and upheld the government order on uniform in schools and colleges.
